These incorporate the Terms and Conditions of Use, the Guest WIFI Acceptable and Fair Use Policy, and the Guest WIFI Privacy Policy.<\/strong><\/p>\n\n\n\n<p><strong>A. Guest WIFI\nTerms and Conditions of Use<\/strong><\/p>\n\n\n\n<p>Before connecting to EightyFen Guest Wi-Fi, please read these terms and\nconditions carefully (the &#8220;Terms&#8221;). These Terms along with our\n&nbsp;Acceptable and Fair Use Policy and Privacy Policy make up the terms and\nconditions for use of EightyFen Guest Wi-Fi. We may make changes to these Terms\nfrom time to time, so we recommend that you review these regularly. The terms\n&#8220;we&#8221;, &#8220;our&#8221; and &#8220;us&#8221; when used in these Terms\nmeans EightyFen. The terms &#8220;you&#8221;, &#8220;your&#8221;, &#8220;yours&#8221;,\n&#8220;buyer&#8221; when used in these Terms means you as a user of EightyFen\nGuest Wi-Fi as the context requires. By checking the \u201cConnect to the Internet\u201d\nbutton that you accept these Terms, you acknowledge that you have read and\nunderstood and agree to all the terms.<\/p>\n\n\n\n<p>IN PARTICULAR YOUR ATTENTION IS DRAWN TO SECTION 3 ON OUR LIABILITY TO YOU If anything is unclear; please contact us before acceptting these Terms.<\/p>\n\n\n\n<p>1. Using EightyFen Guest Wi-Fi&nbsp;<\/p>\n\n\n\n<p>1.1 EightyFen Guest Wi-Fi is a free service available. You can continue\nto use EightyFen Guest Wi-Fi free of charge as long as you continue to accept\nour Terms.<\/p>\n\n\n\n<p>1.2 If you are in any EightyFen building with \u201dEightyFen WiFi\u201d you can\nconnect to the EightyFen Guest Wi-Fi using a compatible phone or computer\ndevice with wireless LAN. We do not guarantee that EightyFen Guest Wi-Fi is\ncompatible with all hardware types and devices or guarantee device\nconnectivity.<\/p>\n\n\n\n<p>1.3 To connect to EightyFen Guest Wi-Fi you will need to provide your\nfull name and email address, and details from the device you are using to\nconnect to our network will be recorded.<\/p>\n\n\n\n<p>1.4 EightyFen Guest Wi-Fi is intended for browsing the internet and\nusing apps.<\/p>\n\n\n\n<p>1.5 We are not responsible for the content of websites you visit while using EightyFen Guest Wi-Fi. We may at our sole discretion restrict access to certain features and websites. If you have any concerns about this or require any further information you can contact us.<\/p>\n\n\n\n<p>1.6 Your use of EightyFen Guest Wi-Fi is limited to 24 hours after which\ntime your connection will end. You can subsequently reconnect to start another\nsession.<\/p>\n\n\n\n<p>1.7 We do not guarantee uninterrupted access to EightyFen Guest Wi-Fi\nand we may suspend the service at any time, for any reason, in our sole\ndiscretion.<\/p>\n\n\n\n<p>1.8 EightyFen Guest Wi-Fi is not a secure network and we are not\nresponsible for the security of the information and data which you transmit\nusing EightyFen Guest Wi-Fi. We are not responsible for the accuracy of any\ninformation or data obtained from the internet using EightyFen Guest Wi-Fi.<\/p>\n\n\n\n<p>2. How we use your information<\/p>\n\n\n\n<p>2.1 By using EightyFen Guest Wi-Fi you agree that your device details\nwill be stored.<\/p>\n\n\n\n<p>2.2 Any activity you undertake on the EightyFen Guest Wi-Fi network will be logged against your device details. We use that data to monitor compliance with these Terms, to prevent and detect crime and to monitor usage of EightyFen Guest Wi-Fi. We reserve the right to report on any activity undertaken on EightyFen Guest Wi-Fi and where necessary restrict or block access to a person, account, website or device.<\/p>\n\n\n\n<p>3. Our liability to you<\/p>\n\n\n\n<p>3.1 Nothing in these Terms shall restrict or exclude our liability for\ndeath or personal injury arising from our negligence or our liability for fraud\nor fraudulent misrepresentation nor any other liability which cannot be\nexcluded or limited under applicable law.<\/p>\n\n\n\n<p>3.2 We shall not be liable to you in contract, tort (including\nnegligence), breach of statutory duty or otherwise arising for:<\/p>\n\n\n\n<p>3.2.1 loss of income or revenue;<\/p>\n\n\n\n<p>3.2.2 loss of business;<\/p>\n\n\n\n<p>3.2.3 loss of profits or contracts;<\/p>\n\n\n\n<p>3.2.4 loss of anticipated savings;<\/p>\n\n\n\n<p>3.2.5 loss of opportunity or goodwill;<\/p>\n\n\n\n<p>3.2.6 loss of, damage to, or corruption, of data; or<\/p>\n\n\n\n<p>3.2.7 indirect or consequential loss of any kind.<\/p>\n\n\n\n<p>4. What you must not do on EightyFen Guest Wi-Fi<\/p>\n\n\n\n<p>4.1 You agree not to:<\/p>\n\n\n\n<p>4.1.1 use EightyFen Guest Wi-Fi for any unlawful or illegal purpose;<\/p>\n\n\n\n<p>4.1.2 use EightyFen Guest Wi-Fi for any commercial purposes;<\/p>\n\n\n\n<p>4.1.3 Make any use of EightyFen Guest Wi-Fi which causes the whole or\npart of EightyFen Guest Wi-Fi to be interrupted, damaged, made less efficient,\nor impair the effectiveness or functionality of EightyFen Guest Wi-Fi in\nanyway;<\/p>\n\n\n\n<p>4.1.4 use EightyFen Guest Wi-Fi for sending or posting any computer\nviruses or any other harmful code, or any material which is defamatory,\noffensive or obscene; or<\/p>\n\n\n\n<p>4.1.5 Use EightyFen Guest Wi-Fi in a way which infringes the rights of\nany person (whether in breach of confidentiality or intellectual property\nrights or otherwise).<\/p>\n\n\n\n<p>4.2 We reserve the right to terminate or restrict your access to Snow\nPeak Guest Wi-Fi, without advance notice, if we reasonably believe that you are\nmisusing EightyFen Guest Wi-Fi or are otherwise in breach of these Terms.<\/p>\n\n\n\n<p>5. Indemnity<\/p>\n\n\n\n<p>5.1 You agree to indemnify and hold us and our subsidiaries, affiliates,\nofficers, directors, agents and employees harmless from and against all\nliabilities, claims, losses or damages (including legal fees) costs and other\nexpenses, however caused, that may arise as a result of or in connection with\ninappropriate or unauthorised access to EightyFen Guest Wi-Fi by you and\/or\nbreach by you of any of these Terms.&nbsp;<\/p>\n\n\n\n<p>6. General<\/p>\n\n\n\n<p>6.1 If any part or provision of these Terms are found to be unlawful or\nunenforceable (including any provision in which we exclude our liability to\nyou), the enforceability of any other party of these Terms will not be\naffected.<\/p>\n\n\n\n<p>6.2 These Terms are governed by English law and subject to the exclusive\njurisdiction of the courts of England and Wales.<\/p>\n\n\n\n<p><strong>B. Guest WIFI\nacceptable and fair use policy<\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>Prohibited Uses<\/strong><\/p>\n\n\n\n<p>This acceptable and fair use policy is additional to our terms and\nconditions of use and privacy policy.<\/p>\n\n\n\n<p>You may use our guest wifi service only for lawful purposes. You may not\nuse it for the following purposes (this list is not exhaustive):<\/p>\n\n\n\n<p>To do anything that includes storing, sending, distributing, uploading\nor downloading:<\/p>\n\n\n\n<ul><li>any content or material which is restricted, prohibited or otherwise\nunlawful under any applicable law (or which is likely to be), including\nmaterial and\/or content which defames, harasses, threatens, abuses, menaces,\noffends, violates the privacy of, or incites violence or hatred against, any\nperson or class of persons, or which could give rise to civil or criminal\nproceedings (or encourages conduct that would be a criminal offence or give\nrise to civil liability);<\/li><li>confidential information, copyright material, trademarks, trade secrets or\nother content which is subject to third party intellectual property rights,\nunless you have a lawful right to do so, or that in any way breaches a third\nparty agreement (including but not limited to a non-disclosure agreement) or\nobligation;<\/li><li>any content or material, which interferes with other users of our wifi\nservice (or may do so) or restricts or hinders any person from accessing, using\nor enjoying the internet, our Services, our network or systems (or the networks\nor systems of our suppliers);<\/li><\/ul>\n\n\n\n<p>To:<\/p>\n\n\n\n<ul><li>do any other act or thing which is unlawful, illegal, fraudulent (or has\nany unlawful or fraudulent purpose or effect) or is otherwise prohibited under\nany applicable law or which is in breach of any code, standard or content\nrequirement of any other competent authority;<\/li><li>access, monitor or use any data, systems or networks, including another\nperson&#8217;s private information, without authority or attempt to probe, scan or\ntest the vulnerability of any data, system or network or to violate the\nprivacy, publicity or other personal rights of others or to impair the privacy\nof communications;<\/li><li>compromise the security, tamper with, hinder the operation of or make\nunauthorised modifications or integrity of any network or system including, but\nnot limited to, our network or systems (or our suppliers&#8217; network or systems)\nor to cause technical disturbances to our network or to our suppliers&#8217;\nnetwork);<\/li><li>knowingly transmit any data, send or upload any material that contains\nviruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware\nor any other harmful programs or similar computer code designed to adversely\naffect the operation of any computer software or hardware;<\/li><li>forge header information, email source address or other user information\nor use another person&#8217;s name, username or password for fraudulent purposes;<\/li><li>transmit, or procure the sending of, any unsolicited or unauthorised\nadvertising or promotional material or any other form of similar solicitation\n(spam), in breach of the Privacy and Electronic Communication Regulations 2003\nor otherwise;<\/li><\/ul>\n\n\n\n<p>To act in any way that:<\/p>\n\n\n\n<ul><li>degrades or interferes with other users&#8217; use of any of our wifi service\n(or may do so) or disrupts or interferes with our network or wifi service or\ncauses a host or the network to crash;<\/li><li>breaches any applicable local, national or international law, regulation\nor code of practice (including export control laws or regulations);<\/li><li>contravenes generally accepted standards of internet or other networks\nconduct and usage, including but not limited to denial of service attacks, web\npage defacement, port or network scanning and unauthorised access to systems;<\/li><li>harms or attempts to harm minors in any way;<\/li><\/ul>\n\n\n\n<p>To assist, encourage or permit any persons in engaging in any of the\nactivities described in this section. If you become aware of any such\nactivities, you must immediately notify us and take all other appropriate\nactions to cause such activities to cease.<\/p>\n\n\n\n<p><strong>Suspension and Termination<\/strong><\/p>\n\n\n\n<p>We will determine, in our sole discretion, whether there has been a\nbreach of this Acceptable and Fair Use Policy through your use of our wifi\nservice. When a breach of this Acceptable and Fair Use Policy has occurred, we\nmay take such action as we reasonably deem appropriate. This action may include\nbut is not limited to:<\/p>\n\n\n\n<ul><li>Issue of a warning to you<\/li><li>Immediate, temporary or permanent withdrawal of the Services<\/li><li>Legal proceedings against you for reimbursement of all costs on an\nindemnity basis (including, but not limited to, reasonable administrative and\nlegal costs) resulting from the breach<\/li><li>Disclosure of such information to law enforcement authorities as we\nreasonably feel is necessary<\/li><\/ul>\n\n\n\n<p>We exclude liability for actions taken in response to breaches of this\nPolicy.<\/p>\n\n\n\n<p><strong>Fair Use<\/strong><\/p>\n\n\n\n<p>Our wifi service is intended for email, instant messaging, internet\nbrowsing and using apps, which we consider fair use. Transferring large amounts\nof data uses up bandwidth and may reduce the speed at which other users of the\nwifi service can access it. In particular, downloading very large files,\nstreaming and using peer to peer and file sharing software require large\namounts of bandwidth and data usage.<\/p>\n\n\n\n<p>If you do not restrict your usage to fair use, we reserve the right to\nissue a warning to you or to suspend or withdraw our wifi service from you\nimmediately, temporarily or permanently; or we may manage your bandwidth so\nthat it may result in reduced service speeds. In addition, we may restrict the\namount of bandwidth available to very heavy users during busy periods to\nmaintain good access for our other users.<\/p>\n\n\n\n<p>Please ensure that your device or hardware is not infected with a virus\nthat sends out data without your knowledge.<\/p>\n\n\n\n<p><strong>Changes To The Acceptable and Fair Use\nPolicy<\/strong><\/p>\n\n\n\n<p>We may revise this Acceptable and Fair Use Policy at any time. You are\nexpected to check this Policy from time to time to take notice of any changes\nwe make, as they are legally binding.<\/p>\n\n\n\n<p><strong>C. Guest WIFI\nprivacy policy<\/strong><strong><\/strong><\/p>\n\n\n\n<p>We take the privacy of our wifi service users very seriously. We ask\nthat you read this Privacy Policy (\u2018the Policy\u2019) carefully as it contains\nimportant information about how we will use your personal data.<\/p>\n\n\n\n<p>For the purposes of the Data Protection Act 1998, EightyFen (\u2018we\u2019 or\n\u2018us\u2019) is the \u2018data controller\u2019 (that is, the organisation who is responsible\nfor, and controls the processing of, your personal data).<\/p>\n\n\n\n<p>By using our wifi service you consent to the collection, use and\ndisclosure of your personal information in accordance with this Policy.<\/p>\n\n\n\n<p><strong>Personal data we may collect about you:<\/strong><\/p>\n\n\n\n<ol><li>We will obtain your personal data (such as your name and email address)\nwhen you sign up to use our wifi service or contact us by telephone, email or\npost. The personal data we hold on you will be adequate, relevant and not\nexcessive.<\/li><li>We may monitor your use of our wifi service by recording how many times\nyou use the wifi service, where you use it, at what times you use it, the\nquantity of data traffic in and how long each session lasts. This information\nhelps us to build a profile of our users for statistical purposes and to\nimprove how we provide our wifi service to you. Most of this data will be\naggregated into groups, which means that we will not be able to identify you\nindividually.<\/li><\/ol>\n\n\n\n<p><strong>How we use your personal data<\/strong><\/p>\n\n\n\n<ol><li>We will use your personal data in accordance with your legal rights\nunder the Data Protection Act 1998. For more information about data protection\nsee &nbsp;<a href=\"http:\/\/www.ico.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>http:\/\/www.ico.org.uk.<\/strong><\/a><\/li><li>&nbsp;We may use your personal data for these purposes:<\/li><li>to enable you to connect to our wifi service<\/li><li>to help us identify you while you use our wifi service<\/li><li>to identify in which areas our users live<\/li><li>administration<\/li><li>research, statistical analysis and behavioural analysis<\/li><li>fraud prevention and detection<\/li><li>to notify you of any changes to our wifi service which may affect you<\/li><li>security vetting<\/li><li>improving our service<\/li><li>requesting feedback from you<\/li><li>responding to your emails, submissions, questions, comments, requests\nand complaints<\/li><\/ol>\n\n\n\n<p><strong>Disclosure of your personal data<\/strong><\/p>\n\n\n\n<p>We may disclose your personal data for processing to:<\/p>\n\n\n\n<ul><li>our partners (and their staff) who help us provide our wifi service to\nyou.<\/li><li>our staff<\/li><li>government bodies and law enforcement agencies in connection with any\ninvestigation to help prevent or detect unlawful activity and in response to\nlegal or regulatory requests<\/li><li>other third parties in connection with possible legal proceedings<\/li><li>other third parties in emergency situations<\/li><\/ul>\n\n\n\n<p>Subject to us complying with our obligations under the Data Protection\nAct 1998, we are not responsible for the actions of service providers or other\nthird parties using your personal data.<\/p>\n\n\n\n<p><strong>Keeping your data secure<\/strong><\/p>\n\n\n\n<p>We will use technical and organisational measures to safeguard your\npersonal data, for example:<\/p>\n\n\n\n<ul><li>we store your personal data on secure servers<\/li><li>all our staff are aware that they must respect the confidentiality of\nyour personal data<\/li><\/ul>\n\n\n\n<p>Whilst we will use all reasonable efforts to safeguard your personal\ndata, you acknowledge that use of the internet is not entirely secure and for\nthis reason we cannot guarantee the security or integrity of any personal data\nwhich are transferred from you or to you via the Internet while using our wifi\nservice.<\/p>\n\n\n\n<p><strong>Information about other individuals<\/strong><\/p>\n\n\n\n<p>If you give us someone else\u2019s personal information, you confirm that the\nother person has appointed you to act on his\/her behalf and has agreed that you\ncan consent on his\/her behalf to the processing of his or her personal data.<\/p>\n\n\n\n<p>We are not liable to any third parties for using their personal data,\nwhere they have not given you consent to give us their personal data.<\/p>\n\n\n\n<p><strong>Your rights<\/strong><\/p>\n\n\n\n<p>You have the right to request access to personal data which we may\nprocess about you. If you wish to exercise this right, known as a subject\naccess request, you should:<\/p>\n\n\n\n<ul><li>put your request in writing<\/li><li>include proof of your identity and address (e.g. a copy of your driving\nlicence or passport, and a recent utility or credit card bill)<\/li><li>specify the personal data you want access to<br>\n<br>\n<\/li><\/ul>\n\n\n\n<p>You have the right to require us to correct any inaccuracies in your\ndata free of charge. If you have concerns\nor questions about their privacy policies and practices, you should contact the\nwebsite operator or publisher.<\/p>\n\n\n\n<p><strong>Changes to this Privacy Policy&nbsp;<\/strong><\/p>\n\n\n\n<p>We may change this privacy policy from time to time.
